The Defendant’s expert accepted the findings of JFL’s report, namely that the tree was obviously suffering from serious basal decay which would have been apparent had it been properly inspected prior to its collapse.

Titled ‘Liability for death or injury caused by falling trees or branches: a review of the present position under English Law in relation to tree safety inspection’, the paper seeks to identify the current position of the courts in this important area, drawing conclusions as to the likely implications of this for tree owners and managers.
